Terms of use
The following "Terms of use" govern access and use of the Application BeSMART of Riello S.p.A. (Hereinafter also known as the "App") and the use of its services. Access to and the use of the Application requires reading, knowledge and acceptance of the following terms of use which will be binding between you (hereinafter also known as the ‘User’) and Riello S.p.A. in the moment in which the User, proceeds to download and subsequently carry out the installation of the App. Failure to accept the Terms of Use, prohibits the User from using the Application (and its services).
Use of the App (and of the software)
The Application and related software are owned by Riello S.p.A. property based in Legnago (VR), Via Ing. Pilade Riello n. 7, C.F. and VAT number 02641790239. Riello S.p.A. grants to the User – subject to the User’s acceptance of the terms and conditions listed below – a free license to use the software on "smart" devices (smartphones, tablets, etc.) with an appropriate operating system as indicated by Riello S.p.A., in order to access the teleservice and remote control offered by Riello S.p.A. and purchased by the User with a separate contract (reference should be made to such a contract for any additional terms and / or conditions not detailed below). The User is expressly forbidden to use the software for any other purpose separate to, or not compatible with, the scope authorized by Riello S.p.A., in addition, the User is also prohibited from translating, adapting, modifying the software, incorporating it into other software or carrying out any type of intervention on the same, even if it’s necessary for the correction of errors The User is also expressly prohibited from proceeding to carry out any reverse engineering, decompiling or disassembly of the Software or any part thereof; or proceed with the redistribution, sale, lease, rental or export, copy, reproduce, modify, or transmit to any third parties the software itself. The Software must be downloaded installed and used by the User at his / her own expense by accessing the "store" of its operating system (Apple, Android, etc.).
Protection of personal data
The use of the Software requires the collection and the processing of personal data. The User will be informed (in accordance with local legislation regarding personal data protection) about the processing of personal data. Based on the User-provided consents, Riello S.p.A. may send advertising or commercial communications including through the use of the software available through the service of "push notifications". The receiving of such notifications can be disabled / enabled via the App or by accessing the settings of the specific smartphone/tablet (or smart device).
Account registration
The use of the App requires registration by the User. Riello S.p.A. cannot be held responsible for any damages or costs to Users, resulting from abuse or misuse of data contained within the account registered; or its use by any unauthorized third parties. The User's authentication credentials (username and password) are personal; any action carried out by using those credentials will be reported to the User itself, who will assume all the consequences and responsibilities, including the payment of any costs, including those relating to the Internet service used.
Copyright
Riello S.p.A. is the licensee of all intellectual property rights contained within the software and the User agrees not to acquire any ownership over such intellectual property, except as expressly provided in these Terms of Use. All text, images, files and artistic and / or technological work, appearing within and / or making up the App (unless otherwise indicated), are the sole property of Riello S.p.A. and they are published in full compliance with current legislation. The use of this material for purposes unrelated to this App is strictly prohibited. The content of the App may not be copied, reproduced, transferred or distributed without the prior written consent of Riello S.p.A.
Trademarks and brands
The trademarks, logos, trade names, and in general, all the distinctive signs that Appear within the App are registered and are property of Riello S.p.A. Nothing contained in the App should be understood or interpreted as granting any license or rights to 'the use of’ such marks, logos, trade names and brands; and these cannot be used and / or accessed without the prior written consent of Riello S.p.A.
Responsibility and Liability
All that appears within the App is provided "as is" without warranty of any kind, whether assumed or implied. Riello S.p.A. will endeavor to maintain and update the App; however it takes no responsibility for the completeness, availability, accuracy, or reliability of the App and the software contained within; nor to the content or the services provided/associated with such. Riello S.p.A. does not guarantee that the App is free of error. The App has finite functionality, and may include (without limitation), possible defects in design and / or programming bugs. Any risk relating to the quality and performance of the App is entirely up to the User, and it will be the responsibility of the User, to ensure that the App is suitable for the intended use and / or application, prior to downloading and using the software. Except in cases of willful misconduct or gross negligence; Riello S.p.A. assumes no responsibility for costs and / or damages, direct or indirect; that the User and / or any third party may incur, as a result of the application or use of the App; including but not limited to damages due to lost profit or savings not realized. Riello S.p.A. cannot, under any circumstances, be held responsible for damages, direct or indirect losses of any kind, costs, expenses, etc. that the User assumes to have suffered due to the effect of malfunction or failure of any service offered or provided by and / or via the App and / or failure to receive information and / or for any inaccuracy or incompleteness. In particular Riello S.p.A. cannot be held responsible if the service is temporarily unavailable or is not available for reasons attributable to the User's own device (smartphone, tablet, etc.). By using the software, the User agrees that this is done at its own risk.
Modifications
Riello S.p.A. reserves the right to issue, from time to time, at its discretion and without notice, new versions of the App (including changes in functionality or interface) which will replace the versions previously released or update the content, Riello S.p.A. reserves the right to change from time to time these Terms of Use at its discretion and without notice. The User is obliged to inquire about the terms of use in force at the time of access and use of the App.
